Professor Zhan Zhongle lectured on ‘Frontier Issues in Domain Legislation’ to the faculty and students of Southeast University Law School

On 10th December, 2024, Professor Zhan Zhongle, Professor of Peking University Law School, Vice President of Administrative Law Research Society of China Law Society, and Vice President of Legislation Research Society of China Law Society, visited Southeast University to give a lecture on ‘Frontier Issues in Domain Legislation’. The lecture was hosted by Professor Meng Hongzhi, Director of Local Legislation Research Base of Southeast University, and Professor Xing Hongfei of Hohai University Law School was the guest speaker. Associate Researcher Zheng Xiaojun, Lecturer Zhang Yunhao and other teachers and students from the Law School of Southeast University participated in the talk.


Professor Zhan Zhongle started from the codification of education code and pointed out that the following eight pairs of relationships should be properly handled in the legislation of the field: firstly, the relationship between the unified code and the separate legislation should be properly handled, the code can't be all-encompassing, and the space of creating adjustments should be reserved for the special norms outside of the code to allow the existence of the separate legislation; secondly, the relationship between the codification of the code and the existing norms should be properly handled, and the code is based on the existing norms to delete, simplify, simplify, and adjust the content of the code. Thirdly, the relationship between the general part of the code and its sub-parts should be properly dealt with; the general and sub-part structure is the general pattern of the code, and the content of the general part and the sub-parts are closely connected in order to fully reflect the systemic nature of the code; fourthly, the relationship between the management of education and the protection of rights should be properly dealt with; it is a law's law that develops from the centre of gravity of obligation to the centre of gravity of power, and the legislation in the field of education and other fields should gradually break through the tradition of management-based legislation; fifthly, the relationship between the management of education and the protection of rights should be properly dealt with. Fifth, the relationship between substantive norms and procedural norms should be properly handled, focusing on the entity but light on the procedure is a common problem of many legislative texts, future education legislation needs to improve the procedural safeguard mechanism for the rights and obligations of education; sixth, the relationship between macro-narrative and micro-norms should be properly handled, both should be given equal weight, and through the configuration of the authorising, obligatory and prohibiting rules, so that the various subjects to play Seventh, the relationship between extraterritorial experience and local conditions should be properly dealt with, and the concept, method and layout of the code should be fully borrowed from foreign advanced legislation; eighth, the relationship between the formulation of the code and its interpretation should be properly dealt with, and the code can be refined through legislative interpretation, administrative interpretation and judicial interpretation.


In the talk session, Xing Hongfei, Professor of Hohai University Law School, discussed with Prof Zhan Zhongle some practical problems in education legislation. He pointed out that the key to measuring the effectiveness of education legislation lies in its effectiveness in solving the real problems of education, and that education legislation has yet to respond to such problems as the length of the school system and the irrational allocation of time in each education stage. Lecturer Zhang Yunhao, Dr Wei Wensong, PhD student Zeng Yamei, PhD student Du Zhonghao, and Lecturer Hua Ziyan from the Law School of Jiangnan University had in-depth exchanges with Prof. Zhan Zhongle on the issues of legislation in the field of education, codification, and legislation in the field of public health, respectively.


Finally, Prof Meng Hongzhi summarised the content of Prof Zhan Zhongle's lecture and expressed his sincere thanks to Prof Zhan Zhongle. The lecture was successfully concluded with warm applause.
