Professor Mo Yuchuan Gave a Lecture on the Theme of "Chinese Path to Modernization and Emergency Rule of Law Construction - Innovative Highlights and Important Topics of the Overhaul Project of the Emergency Response Law" to Our Teachers and Students

On January 11, Mo Yuchuan, professor and doctoral supervisor of Renmin University of China Law School, was invited to give a lecture on the theme of Chinese path to modernization and emergency rule of law construction - innovative highlights and important topics of the overhaul project of the Emergency Response Law at the Law School of Southeast University. This lecture is hosted by the Jiangsu Provincial Local Legislation Research Base of Southeast University and presided over by Professor Meng Hongzhi from the School of Law of Southeast University. Professor Li Yuxing and Professor Zhang Yunhao from Southeast University, Professor Wang Qian from the Nanjing Municipal Party School of the Communist Party of China, as well as master's and doctoral students from Southeast University, China University of Political Science and Law, and Northeastern University participated in this lecture.

 

Professor Mo Yuchuan, starting from the decision of the Third Plenary Session of the 20th Central Committee of the Communist Party of China on emergency rule of law requirements, pointed out that emergency rule of law is an important guarantee for promoting the modernization of the national security system and capabilities. Based on a review of the public emergency concept and emergency rule of law principles, as well as an in-depth explanation of the General Secretary and the Party Central Committee's discourse on emergency rule of law, Professor Mo Yuchuan focused on interpreting the innovative highlights of the major overhaul project of the Emergency Response Law. The revised Emergency Response Law has significantly increased its text volume, adding many new concepts, systems, mechanisms, and methods, which can be summarized as the following five innovative points: firstly, through the modification of legislative purpose clauses and the incorporation of Party leadership into the law, the basic institutional system has been adjusted and improved; Secondly, an emergency rule of law principle system has been formed, which emphasizes overall safety, putting the people first, scientific response, and prevention as the main focus; Thirdly, a series of legal norms have been designed to protect the legitimate rights and interests of special groups; The fourth is to clarify the legal responsibilities of local governments, their departments, relevant units or individuals in various situations. The fifth is to add provisions to strengthen psychological health rescue in accordance with the law. Finally, Professor Mo Yuchuan gave a lecture on the experience and lessons learned from the development of emergency rule of law, as well as the establishment of a standardized system, capability system, and knowledge system for emergency rule of law.

 

During the communication session, Zhang Weijia, a master's student from the School of Law at Southeast University, raised questions about the amendment of Article 12 of the Emergency Response Law and whether it is necessary to establish an emergency collection system. Zeng Yamei, a doctoral student from the School of Law at Southeast University, raised questions about the principles of emergency rule of law, the division of responsibilities of supervisory departments in emergencies, and the application of party regulations and national laws. Professor Mo Yuchuan answered each question one by one.

 

In the summary section of the academic conference, Professor Meng Hongzhi, on behalf of all teachers and students, expressed sincere gratitude to Professor Mo Yuchuan for his visit to Southeast University, and gave excellent academic comments on the lecture content.
