The 24th Southeast Law Young Teachers Salon of Our College Was Successfully Held

On the afternoon of January 8th, the 24th Southeast Law Young Teachers Salon Academic Month themed salon was successfully held in the conference room on the fourth floor of the Law School. This salon is organized by the Youth Teacher Development Committee of the Law School, with Associate Professor Chen Daoying from the Constitutional and Administrative Law Teaching and Research Office serving as the moderator. Professors Gong Xianghe, Liu Lianjun, Zhang Xuelian, Zhu Shanshan, Wei Wensong, and other young teachers and students from the Law School also participated in this event. The theme of this salon is Constitutional Human Rights Academic Month.

 

In the thematic report section, Teacher Wan Qianhui mainly discussed the dilemma faced by learners as one of the core subjects of educational legal relationships in the process of compiling legal codes, including iterative disputes over the connotation of subject concepts, confusion in typological logic, and unclear rights structures. In this regard, it is necessary to further develop departmental constitutional methods by prioritizing the formal methods of moderate codification and the substantive methods of constitutional guidance, with legalization clauses as the core basis, specialized content as the main aspect, and the protection of citizens' basic rights as the central orientation, to construct the normative connotation of rights subjects and the natural hierarchy of rights content.

 

Researcher Zhu Shanshan pointed out that currently, after years of practice and development, the review and filing of party regulations in China has become a separate entity, but there are still some problems. By comparing with the national legal filing review system, the basic content and characteristics of the internal party regulations filing review system can be clarified. It is found that there are overlapping areas between the internal party regulations filing review system and the national legal filing review system, such as unclear filing review subjects and unclear application of filing review procedures. To address these issues, a linkage mechanism with communication and consultation as the core and legality review as the main content will be constructed, which will create a new realm for the legalization of internal party regulations.

 

Wei Wensong, a postdoctoral fellow, believes that the compilation of the Education Code not only needs to give education laws a civilized and institutionalized temperament in form, but also needs to ensure that education laws can promote educational equity and demonstrate the spirit of the rule of law in essence. The construction of the Education Code can be based on the plan of first introducing general provisions and then formulating specific provisions in terms of compilation ideas, so as to ensure the gradient development of legislative work, and at the same time, it is necessary to reasonably construct legal responsibilities to ensure the integrity of the Education Code system. Due to the special nature of the Education Law, administrative responsibility is a key component of educational legal responsibility and occupies an indispensable position. Therefore, in the compilation of the Education Code, it is necessary to carefully consider the system construction of administrative responsibility.

 

During the seminar, Professor Gong Xianghe, Professor Liu Lianjun, Associate Professor Zhang Xuelian and other teachers provided comments and discussions on the above-mentioned theme reports. The salon was a complete success.

 

The Youth Teacher Development Committee of the Law School focuses on the theme of the Academic Year of Southeast University in 2024, adhering to the principle of academic supremacy, and has launched a series of brand activities such as the Southeast Law Youth Academic Month. As a Youth Academic Month activity for the Constitution discipline, this salon provides useful support for fully stimulating the innovative vitality of law school teachers and students and enhancing academic abilities.
